“Inadequate equipment”
We were looking for a sailing yacht for the Canary Islands that was equipped for the strong wind conditions prevailing there. The most important requirement was that it had three reefs. This was confirmed by Five Seasons, the brokerage agency. With that, nothing stood in the way of signing the charter contract for a Sun Odyssey 379 for four weeks. We arrived in Tenerife a few days early and reported to the charter company. Here we were informed that the yacht only had two reefs and that they did not have any yachts with three reefs at all. So we had no choice but to accept this significant shortcoming. We immediately reported this shortcoming to the brokerage agency. After taking over the yacht, which took place under great time pressure and with an hour's delay, further defects came to light: non-functioning navigation lights, one of two gas burners unusable due to blockage, and the spare gas bottle empty. The next morning, the gas cylinder was replaced and the starboard navigation light was repaired. It was claimed that the steamer light was working, but this could not be verified in daylight. As it turned out later, it was not working. After a few days, we also had problems with the depth gauge and a failure of the autopilot. When we reported this to Five Seasons, we were told that we had reset the autopilot and were therefore to blame for the failure. Using Google search and our own intuition, we got both the depth gauge and the autopilot working again. A few days later, the starboard navigation light failed completely. The housing, which was only secured with two cable ties, was leaking and the bulb was broken. We didn't have a replacement on board, so we had to get cable ties and a bulb ourselves. We couldn't find a bulb in any of the stores we visited, but a helpful sailor gave us one from his supply. When we arrived back at Marina San Miguel, the manager of Five Seasons asked us what was going on with the depth gauge and autopilot. We told her that we had got both working again. We were then asked to moor the yacht backwards at the jetty. We had moored forward because the gap between the finger pier and the neighboring boat was so narrow that it was almost impossible to moor without causing damage. Instead of helping us to move the yacht or doing it themselves, they made us carry out the maneuver in unfavorable wind conditions under threat of charging us for the cost, which then led to minor damage to the neighboring boat. So our four-week charter ended with a bill for the minor damage and for the allegedly reset autopilot, instead of compensation for the missing third reef and for the repair of the navigation light. Addendum: The agency negotiated on our behalf that we would at least be reimbursed for the invoice amount.
